GAY MARRIAGE: A HUMAN RIGHT

Same-sex marriage, popularly known as gay marriage, is the tradition of marriage between two men or between two women. Although same-sex marriage has been restricted through the constitution, belief, and tradition and civil acceptance have varied in most nations of the earth, the valid from festivity on the one needle to criminalization on the other. There are records of same-sex marriage dating back to the first century. In the modern era, the first legislation legalizing same-sex marriage took effect in the Netherlands on 1 April 2001. Today, it is available in 29 countries.

Nearly two years have passed since the notable IPC Section 377 Judgement, in which the Supreme Court of India legitimatize homosexuality. The 200+ page evaluation not only brings out the floors of decriminalization but moreover some of the statements made by the opponents. The recognition of same-sex marriage is considered to be a human right and a civil right.

The court unites with the pleaders by declaring openly, “An individual’s sexual frontage is natural to their entity. It is attached to their temperament and individuality. A sequence which separates between individuals based on their inherent nature would be violative of their primary liberties, and cannot overcome the test of constitutional integrity.” Same-sex marriage enables pairs to collectively accept and attention against linking the right to marry with independence from injustice and discrimination.

Bollywood too has ‘stepped out of the cabinet’ by starring well-known entertainers as homosexual personalities in same-sex utopian relationships. Dutee Chand, an Asian Games silver medalist and India’s initial (and only) open gay athlete previously appeared out of the nook and disclosed that her same-sex spouse was her ‘soulmate’. It was the Supreme Court decree that provided her with the strength and courage to pipe up about her confidential life.

Certainly, the voyage forward is lengthy and complicated, but the youths in India are enterprising and have their whole existence ahead of them.
